Monday Morning brought a press conference on the matter, with Uli Simma and others.

I was impressed by the interst the topic raised, with basic media Coverage via APA-OTS

and articles in “Mein Bezirk”, “Heute”, ORF, Krone, Die Presse Kurier, Vienna’s official Twitter account etc.

A follow-up article in Der Standard summarizes the situation but doesn’t bring any new legal argument.

The heart of the problem is § 53 section 5 Police Law (“Sicherheitspolizeigesetz”, SPG). Epicenter.works collected their arguments some time ago.

Figaró on NIS2

Profil covered my statement on Austriua’s failure to transpose the NIS2-directive - as expected last week.

There was a funny typo (corrected now) in the article.

It’s very likely that this issue will not be solved in due time, within this legislative term.

Are there good reasons to limit access to mobile-phone data to specific police units or is it necessary to give state prosecutors full access to and control of these data? Richard Soyer and Ohilip Masch have a quite clear opinion on this that we debated on Thursday.

Both were very, very critical about the legislative process - its timing and its content - and were oustandingly critical onm timing, content and political motivation of the draft. The topic will be further discussed next week (see below).

I learned a lot on Twitch and Discord as platforms for lawyers from Stephan Klawitter.

Twitch seems (still) to be quite unknown territoriy for (German speaking) lawyers.

We will deal in more detail with the suggested reform of Austria’s Code on Criminal Procedure and its impact on privacy and data protection.

The interview with the president of Austria’s public prosecutors, Elena Haslinger, was rescheduled for Wednesday July 10th at 10.30 am and will summarize their very critical statement.

I will (re-)discuss the topic also with Shirin Ghazanfari, also on Wednesday, at 20.00 CET.

Ghazanfari is writing her PHD on the topic and discussed with me on the general proble already in #arsboni 473.

Writing

I’m currently finishing not less than four books, two of them on the AI-act, one on AI in general, one on platforms. You may expect (or fear!) more than 2000 pages legal text I am somehow responsible for (mostly as co-editor, in parts as an author), hopefully later this year. Some announcements on this are out already.

Everyone is writing like mad on AI at the moment, there will be an avalanche of legal litterature on the matter in autumn and winter.

doesn’t understand why all the bipeds have started to constantly stare into a green screen and radomly scream at it. She hopes that this will be finally over - on Sunday, at the very latest.
