Retrospect
Edtstadler
Minister Edstadler wrote a reply on my article in profil. It appeared in “Kurier” and also on her Twitter and Instagram. The online versions have remarkable additions at the beginning and at the end, personally criticising people not agreeing with her. Many readers - including Martin Thür - interpreted this a a rather unfriendly gesture (“Kleine Nachhilfestunde für alle vermeintlichen Menschenrechtsexpert:innen.”) directed to me.

This triggered some attention and very clear replies. in particular from Hans Peter Lehofer whom I am very grateful for sacrificing his last sunday on this matter.

Substantial criticism came also from Dr. Maria Windhager

and a pseudonymous account called "Legalitätsprinzip”

I gave another TV-Interview on the issue (from my laundry) on Monday for Puls24.
Cancer Care
#arsboni 456 dealt with the advisory board on cancer drug evaluation with only a minority of medical doctors.
Professor Sevelda was more optimistic than Professor Zielinski (and me). Since then I have had several conversations with experts in the domain and some of the told me that the final text might change significantly - but I didn’t have the time yet to search for leaks and to verify this.
On November 22 another draft for another law on (better?) access to medical data for research was presented - “Vereinbarungsumsetzungsgesetz 2024 - VUG 2024 (2310 d.B.)” (what a strange title).
The text (50 pages) contains provisions on a ”Plattform zur gemeinsamen Sekundärnutzung von Daten aus dem Gesundheitsbereich“ that looks “interesting” from a data protection point of view. A first critique in research related aspects was already written by Harald Oberhofer.
Habitus
Profesor Hanschmann spoke about habitus, social capital and legal education and I asked questions about proper suits for lawyers .
Palace
I had a very intersting meeting in one of Vienna’s beautiful palaces. It’s too early to tell any details but I share some impressions already today. More news to come soon. Do you see where I am?


Kucsko and Copyright
The 3rd edition of Handig/Hofmarcher/Kucsko’s systematic commentary on Copyright is out. The authors were invited by the editors to a release party. As I have the privilege to be one of them (with a very tiny contribution, though), I got the opportunity to join.

Some of Guido Kucko’s conceptional art was exhibited in the beautiful artmark.galerie at this occasion.

Prospect

On Wednesday, November 29 2023, 10.00 CET we will deal with the interplay between media usage and political preferences (in German). My guests are distinguished experts in media and political sciences from University of Vienna.
In addition, I will record two sessions in the laundry.
One with Dr. Florian Philapitsch (again) on the aftermaths of the Constititutional Court’s Decision on unconstitutional provisions in the law on Austria’s public broadcaster ORF. This is the point of reference:
And the other one will be - hopefully - with Julian Hessenthaler. We have been trying to find a possibility for quite some time now, but it looks rather good this week.
Digitalisierungsdiskurs
I will return to Hannover (remotely) on Tuesday, with a keynote on digitalisation in legal education. The event is organised by my former colleagues at the Institute for Legal Informatics. The project is called DiDi: DigitalisierungsDiskurse – Disziplin- und projektübergreifende Forschung zu Digitalisierungsthemen zugänglich machen.
Cyberlaw, Brno
Brno with its Cyberspace Conference at Masaryk University is just ahead.
Frauenhuber
I enjoyed an hour or two of reading and writing in Cafe Frauenhuber this week and it was like a time machine back to Vienna in the 80-ies. A “Buttersemmel” doesn’t taste better anywhere.

And Daisy was out for another walk in the vineyards, chasing the last wineleaves.
